Habitual Residence

Johnson v. Schubert | 2018 BCSC 74 | British Columbia Supreme Court

Habitual residence is not a defined term under the Hague Convention. It is a question of fact which can be established by residing in a particular place for an appreciable period of time with a “settled” intention.
