The Limitations of Limitation Periods in Estates Litigation

Over the past year, the Court of Appeal for Ontario has released a number of decisions which consider the application of limitation periods in trusts and estates litigation. Two of these decisions, discussed in the newsletter below, serve as important reminders of the limitations of limitation defences to claims against estates.
